The loss of a loved one is never easy. The situation can be even harder when the death was untimely, caused by someone else’s negligence or recklessness.
At Ellis Roberts Law, we believe that South Carolinians who have lost a loved one due to others’ negligence deserve compensation for the hurt they are feeling and the loss they have experienced. Types of Wrongful Death Cases
Unfortunately, negligence and misconduct can cause far worse damage than a personal injury. When an accident leads to death at no fault of the victim, their surviving family members have the right to file a wrongful death claim in the pursuit of damages. Our Charleston wrongful death attorney are here to help you pursue justice and the financial compensation you need to cover funeral expenses, unpaid medical bills, and your pain and suffering.
At Ellis Roberts Law, LLC, we routinely handle wrongful death claims caused by:

Who Can File a Wrongful Death Claim in Kansas?
According to South Carolina law a spouse, child, or parent, grandparent or sibling may file a wrongful death claim on behalf of a deceased loved one. A child of the deceased may only bring a claim if there is no surviving spouse. Likewise, a parent of the deceased may only file a claim if there is no surviving spouse or child.
In cases where there is no surviving spouse, child, or parent a representative of the deceased’s estate may file a wrongful death claim, recoverable by the deceased’s next of kin. In all South Carolina, the statute of limitations to file a wrongful death claim is three years. This means you have three years from the date of your loved one’s death to file a claim or you may lose your opportunity to do so.
